Terms of Use

FitnessGiving.com is operated by Wizewerx Ltd, registered in England and Wales with company number 06003824, whose registered office is 124 City Road, London, England, EC1V 2NX. The platform lets an organisation fund a campaign from its own budget, and lets participants earn from that budget through recorded physical activity in order to donate it to UK registered charities.

By using the platform you agree to these terms. If you are using it on behalf of an organisation, you confirm you are authorised to accept them for that organisation.

You must provide accurate account information and keep your credentials secure. You are responsible for activity carried out under your account. You must be old enough to form a binding contract in your jurisdiction.

Activity must be genuinely performed by the participant who records it. Falsifying activity — whether by manual entry, by device manipulation, or by recording activity performed by somebody else — is a breach of these terms.

Where we have reasonable grounds to believe activity has been falsified, we may withhold or reverse the corresponding earnings and suspend the account. Where earnings have already been donated, we will not seek to recover funds from the receiving charity.

1. Money committed to a campaign belongs to the sponsoring organisation until it is donated to a charity.
2. Earnings held in a participant's giving wallet can only ever be donated to a UK registered charity. They cannot be withdrawn as cash, transferred to another person, or exchanged for anything else.
3. Unused campaign funds return to the sponsoring organisation's platform wallet for future campaigns, or are directed to charity at the organisation's instruction.
4. A campaign does not begin until it has been funded.

Activity data originates from third-party fitness tracking services and the devices that record it. We present it as we receive it and do not warrant its accuracy. Earnings are calculated from that data, so any inaccuracy in it carries through.

Sponsoring organisations pay an annual subscription for access to the platform, and a campaign fee of 3% of the amount funded for each campaign they run, subject to a minimum of £150 per campaign. A sponsor’s first campaign is free of the campaign fee, up to a £5,000 campaign budget.

We do not take a percentage of campaign funding or of donations. The full amount an organisation commits to a campaign is available to be earned by participants and donated to charity. The campaign fee is a separate charge for operating the campaign, invoiced in addition to campaign funding and never deducted from it.

Subscription and campaign fees are subject to UK VAT (Wizewerx Ltd VAT number GB472659164). Campaign funding is invoiced and payable within the terms stated on the invoice. We may change subscription and campaign fee pricing, and will give existing subscribers reasonable notice before a change takes effect for them — a change will not be applied to a term already paid for, or to a campaign already funded.

Content you upload — campaign descriptions, images, profile details — must be lawful, must not infringe anyone's rights, and must not be offensive or misleading. We may remove content that breaches this.

You may close your account at any time. We may suspend or terminate an account that breaches these terms. Where an account is closed, any undonated earnings in a giving wallet return to the sponsoring organisation, because that money was always theirs until donated.

The platform is provided as-is. To the extent permitted by law we exclude implied warranties, and we are not liable for indirect or consequential loss. Nothing in these terms excludes liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded.

Physical activity carries inherent risk. You are responsible for exercising safely and within your own capability, and for seeking medical advice where appropriate.

The platform, its software and its branding remain our property. You keep ownership of content you upload, and grant us the licence needed to display and operate it within the platform.

These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction.

We may amend these terms. Where a change materially affects your rights or what you pay, we will give notice rather than relying on you noticing the date above.
